ROCKY REACH TRAIL TWO-YEAR REVIEW
November 21, 2017 

The public hearing on the two-year review of the effectiveness of mitigation measures for the Rocky Reach Trail will be conducted by the Douglas County Hearing Examiner on Thursday, December 7, 2017.  The hearing will begin at 1:30 PM and will be held in the Hearing Room of the Douglas County Public Services Building.

Seventy-one (71) pieces of correspondence were received during the month-long period soliciting comment on the effectiveness of the mitigation measures for the Rocky Reach Trail.  The comments have been compiled and can be viewed/printed by following the link below.

The comments will be reviewed and summarized prior to the setting of a public hearing.  Notice of the date, time and place of the hearing will be broadly distributed.

Background

The Douglas County Board of Commissioners adopted Resolution TLS 08-09B on March 25, 2008.  This resolution ratified action by the Douglas County Hearing Examiner that approved the Rocky Reach Trail extension to the Apple Capital Loop Trail.  The Hearing Examiner approved a Recreation Overlay (R-O 06-01) and a Site Plan Development permit (SPD 06-02) on November 3, 2006 and a Shoreline Management Substantial Development Permit (SP 02-87) on January 12, 2004. 

In ratifying the action by the Hearing Examiner, the Board of Commissioners established a condition that the mitigation measures for the Rocky Reach Trail be reviewed by the Hearing Examiner two years after the trail is opened. This condition states:

“Two years after the Rocky Reach Trail has been opened for use, the Douglas County Hearing Examiner shall hold a public hearing to review and consider the effectiveness of the mitigation measures required by this approval.  The review shall be performed in accordance with the procedures in place at that time and shall determine whether or not the mitigation measures should be modified.”

Trail Opening 

The Rocky Reach Trail opened on July 9, 2015 and this is notice that the two-year review has started.

What’s Being Reviewed 

The review required by the Board of Commissioners is narrowly defined as the “…effectiveness of the mitigation measures…”  The mitigation measures are identified in the conditions in the approvals of the Hearing Examiner and the Board of Commissioners.  These can be reviewed by following the “Available Documents” link.   

What’s Not Being Reviewed 

This review does not extend to other, non-mitigation measure issues such as additional trail access points, design and operational issues not addressed in the approvals, general etiquette of trail use, etc.

How to Comment

Comments on the effectiveness of the mitigation measures, including potential modifications, can be submitted electronically to the following link or by US Postal Service mail to the address below.  The comment period begins Thursday, August 31, 2017 and continues until 5:00 PM on Monday, October 2.
